Form HR1 home rights notice — the complete father's guide
HR1 is the HM Land Registry form that registers a notice of home rights — the practical protection for a non-owning spouse or civil partner. Fee: none. Consent needed: none. Source: GOV.UK — Notice of home rights (HR1).
Who can register
- You are married or in a civil partnership, and
- the home (your only/permitted home — the "matrimonial home") is legally owned or leased by your spouse alone.
Not married? HR1 is not available — the cohabiting position is different and harder (see the home exclusion guide). Joint owner? You already have legal rights on the title; HR1 adds little.
What the notice actually does
- Blocks dealings without your knowledge A sale or remortgage cannot normally complete over a live home-rights notice — buyers' and lenders' solicitors will not proceed until it is dealt with.
- Protects your occupation right Together with s.30 FLA 1996, it underpins your right not to be excluded from the home except by court order.
- Not a claim to ownership The notice protects rights; it does not create a share. Your financial claim (if any) runs separately in financial remedy.
Filling it in without rejection
- Title number — the number-one rejection cause. Get it exactly right from the Land Registry (search by address; register copy £7 if needed).
- Panel 6/7 details — marriage details and addresses; complete every panel legibly.
- Post to HM Land Registry Citizen Centre, PO Box 74, Gloucester GL14 9BB. Keep a copy and proof of posting — priority dates from receipt.
- Property Alert — also register the free Land Registry Property Alert: if anything touches the title, you get emailed. Tripwire + lock, together.
Duration and removal
- The notice lasts while the marriage does (until decree absolute/final order ends home rights) — HR2 renews in specific circumstances.
- It comes off by Form HR4 (free) — usually at settlement, timed with the transfer or sale. Do not remove it early as a goodwill gesture.
- If she disputes the notice, the Land Registry notifies and she can object through the registry's procedure — registered rights stand until cancelled.
HR1 in one line: it converts an invisible right into a wall. Free, an hour of paperwork, posted to Gloucester — and the house cannot be quietly sold over your head while you fight for contact.
Before your hearing
Turning scattered messages, notes and dates into evidence takes structure. apply this guide to your own documents — EvidenceCanvas is a guided toolkit that helps you draft a child-focused witness statement, answer a Scott Schedule point by point, and assemble a paginated court bundle. It is not a law firm and does not give legal advice.
